A German regional court has ordered Robert Bosch GmbH to turn over emails about its business with Volkswagen AG in connection with two lawsuits about VW’s diesel emission cheating, Reuters reports.
The lawsuits have been filed by investors who claim Porsche Automobil Holding SE, which owns a controlling stake in VW, failed in 2015 to promptly reveal the financial risks of the scandal.
Bosch is involved because it supplied VW with electronic emission control devices used to cheat pollution rules. The Stuttgart court rejected Bosch’s claim that the company has the right to refuse the requests.
The court points out that Bosch wouldn’t risk incriminating itself because the emails show Bosch did not influence the timing of Porsche SE’s disclosure of the cheating. The court also says Bosch cannot claim a need to protect trade secrets if those secrets involve illegal software.
